Is the person
you rent from a tenant in your house or apartment?
Answer
Yes if the person you rent from is a residential tenant who lives
in the same house or apartment unit as you do. For example, the person you
rent from:
- rents the
whole house as their home, and then rents out a room or apartment in the
house to you; or
- rents an
apartment as their home, and then rents out a room or part of a room in
the apartment to you.
Answer
No if the person you rent from is not a residential tenant who
lives in the same house or apartment unit as you. For example, if the
person you rent from is:
- a commercial
tenant of the building who does not live there, such as someone who rents
a store and apartment from the owner of the building, and rents the apartment
to you; or
- someone who
rents a whole building or complex from the owner and then rents out units
or rooms as a business, even if that person also lives in the building or
complex. (This person is probably a commercial tenant, but in some situations
it may be unclear. Try to get legal advice.)
