What does subletting mean?
Subletting means you let someone take over your rental unit for a period and remain responsible for the lease.
For example, you have a one-year tenancy from January to December. You will be out of town in the summer, so you sublet your rental unit to a friend for June and July. You can move back in after July.
The person who moves in, your friend, is called your subtenant.
Although you move out for a period, you remain the tenant and are still responsible for the lease. For example, if your subtenant‑friend does not pay the rent or causes damage, you will have to pay it.
For a sublet to exist:
- Your landlord agrees to the sublet.
- You move out of the rental unit.
- Your friend has specified dates to move in and out before the end of your lease.
- You have the right to move back into the rental unit.
The sublet period must be shorter than your lease period. For example, if you rent month-to-month, the sublet must end at least a day before the end of one month.
And you cannot charge more rent than what the landlord charges you.
