New rules apply to refugee claims made on or after June 3, 2025. If people are not eligible to make a refugee claim because of the new rules, in most cases, they can apply for a <a href=\"https:\/\/stepstojustice.ca\/questions\/refugee-law\/what-pre-removal-risk-assessment-and-can-i-apply\/\" target=\"_blank\" rel=\"noopener\">Pre-Removal Risk Assessment (PRRA)<\/a>. They should <a href=\"https:\/\/stepstojustice.ca\/questions\/refugee-law\/where-can-i-get-legal-advice-and-help-my-refugee-claim\/\" target=\"_blank\" rel=\"noopener\">get legal help<\/a>.<\/p>\n<h2>One year rule<\/h2>\n<p>People are <a href=\"https:\/\/stepstojustice.ca\/questions\/refugee-law\/can-i-make-refugee-claim-canada\/\" target=\"_blank\" rel=\"noopener\">not eligible to make a refugee claim<\/a> if they entered Canada on a date after <strong>June 24, 2020<\/strong>, and more than <strong>one year<\/strong> has passed since that entry.<\/p>\n<h2>Irregular entry at Canada-U.S. land border<\/h2>\n<p>People who enter Canada <strong>irregularly<\/strong> by crossing the Canada-U.S. land border between official ports of entry and make their refugee claim more than <strong>14 days<\/strong> after entering:<\/p>\n<ul>\n<li>are no longer eligible to make a refugee claim<\/li>\n<li>can usually stay in Canada to <a href=\"https:\/\/stepstojustice.ca\/questions\/refugee-law\/what-pre-removal-risk-assessment-and-can-i-apply\/\" target=\"_blank\" rel=\"noopener\">apply for a PRRA<\/a>.<\/li>\n<\/ul>\n<p>The <a href=\"https:\/\/stepstojustice.ca\/questions\/refugee-law\/can-i-make-refugee-claim-canada-if-im-coming-us\/\" target=\"_blank\" rel=\"noopener\">Safe Third Country Agreement (STCA)<\/a> still applies to them within 14 days after entering.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Steps to Justice has updated information on who can make a refugee claim.
