{"id":46296,"date":"2012-06-19T10:06:28","date_gmt":"2012-06-19T14:06:28","guid":{"rendered":""},"modified":"2024-09-06T15:40:32","modified_gmt":"2024-09-06T19:40:32","slug":"step-five-get-ready-for-the-hearing","status":"publish","type":"publications-page","link":"https:\/\/www.cleo.on.ca\/en\/publications-page\/step-five-get-ready-for-the-hearing","title":{"rendered":"Step 5: Get ready for the hearing"},"content":{"rendered":"<p>If you are appealing a decision that says you are <strong>not a person with a disability<\/strong>, you have to:<\/p>\n<ul>\n<li>get any new medical information to both the Social Benefits Tribunal (SBT) and the Disability Adjudication Unit (DAU)<\/li>\n<li>do this at least <strong>30 days<\/strong> before the hearing<\/li>\n<\/ul>\n<p>If you are appealing <strong>any other decision<\/strong>, your documents are due at least <strong>20 days<\/strong> before the hearing.<\/p>\n<p>The SBT rules say when you have to give the documents to the SBT and the office that made the decision you are appealing.<\/p>\n<p>The office that made the decision you are appealing also has to follow rules about how and when to give forms and reports to the SBT and to you.<\/p>\n<h2>Rules about documents, forms, and witnesses<\/h2>\n<p>There are detailed rules that you have to follow when you appeal to the SBT.<\/p>\n<p>For example, there are rules about <strong>how<\/strong> and <strong>when<\/strong> you must:<\/p>\n<ul>\n<li>prepare documents, including formatting, page numbers, and having a cover page that lists documents<\/li>\n<li>use SBT forms, for example, New Medical Information (Form 5) and Notice of Human Rights Code Claim (Form 4)<\/li>\n<li>file documents, including rules about using fax or email<\/li>\n<\/ul>\n<div>\n<p>You file your documents when you give them to the SBT and have followed the rules about how to do this.<\/p>\n<\/div>\n<p>There are also rules about <strong>how<\/strong> and <strong>when<\/strong> you must:<\/p>\n<ul>\n<li>give copies of documents to the office that made the decision you disagree with, and prove that you have done this<\/li>\n<li>give a list of any witnesses who will give evidence at your hearing to the SBT and the office that made the decision you disagree with<\/li>\n<\/ul>\n<p>The rules and the forms are on the SBT&rsquo;s website at <a href=\"https:\/\/tribunalsontario.ca\/sbt\/\" target=\"_blank\" rel=\"noopener\">www.tribunalsontario.ca\/sbt<\/a>.<\/p>\n<h2>If you do not follow the rules<\/h2>\n<p>If you do not follow all of the rules, the SBT can <strong>refuse<\/strong> to:<\/p>\n<ul>\n<li>consider documents<\/li>\n<li>hear from a witness<\/li>\n<li>consider evidence<\/li>\n<li>consider your reasons for appealing<\/li>\n<\/ul>\n<p>Even if you do not follow the rules, the SBT may decide that they will still look at your documents and evidence, and hear from your witnesses. But they <strong>do not<\/strong> have to do this. So it is very important to follow the rules.<\/p>\n<p>Keep a copy of everything you file with the SBT.
