{"id":46902,"date":"2012-04-24T19:07:14","date_gmt":"2012-04-24T23:07:14","guid":{"rendered":""},"modified":"2025-12-10T12:03:20","modified_gmt":"2025-12-10T17:03:20","slug":"rules-about-trusts","status":"publish","type":"publications-page","link":"https:\/\/www.cleo.on.ca\/en\/publications-page\/rules-about-trusts","title":{"rendered":"Rules about trusts"},"content":{"rendered":"<p>When you have a trust, someone called a &#8220;trustee&#8221; manages your inheritance for you.<\/p>\n<p>A trustee can also be an organization like a bank or a community organization.<\/p>\n<p>ODSP does not count an inheritance of <strong>$100,000 or less<\/strong> as an asset if the money is in a trust. The trust must be set up:<\/p>\n<ul>\n<li>following ODSP rules, and<\/li>\n<li>within 6 months of when you get the inheritance.<\/li>\n<\/ul>\n<p>ODSP does not count an inheritance of <strong>more than $100,000<\/strong> as an asset if the money is put in a &#8220;discretionary trust&#8221; or &#8220;Henson trust&#8221;. This means that the trustee gets to decide when to pay you and how much.<\/p>\n<p>The person who gives you the inheritance must set up this kind of trust in their will.<\/p>\n<div class=\"box\">\n<p>ODSP counts a payment from a trust as <strong>a gift<\/strong>.
