They must sign it as well and usually need to be with you when you sign.<\/p>\n<p>Your witnesses <strong>cannot<\/strong> be:<\/p>\n<ul>\n<li>your spouse or partner, your child, or someone you treat as your child,<\/li>\n<li>your attorney or their spouse or partner,<\/li>\n<li>anyone who&#8217;s younger than 18, or<\/li>\n<li>anyone who has a Guardian of Property, a Statutory Guardian, or a Guardian of the Person.<\/li>\n<\/ul>\n<p>Your <strong>spouse<\/strong> is someone you&#8217;re married to.<\/p>\n<p>If you&#8217;re <strong>not<\/strong> married, they&#8217;re your spouse if you live in a relationship that&#8217;s like a marriage. And you:<\/p>\n<ul>\n<li>have lived together for <strong>at least<\/strong> one year, or<\/li>\n<li>have lived together for <strong>less than<\/strong> one year and have a child together, or<\/li>\n<li>have a <strong>cohabitation agreement<\/strong>, which is a contract that says how unmarried partners will deal with issues.<\/li>\n<\/ul>\n<p>Your <strong>partner<\/strong> is someone you have been living with for at least one year.
