New EI appeal process

Steps to Justice has information about the new Employment Insurance (EI) appeal process.

Starting April 1, 2026, there’s a new process to deal with some appeals about EI decisions.

If you’re not happy with Service Canada’s EI reconsideration decision, you can now appeal to the new Employment Insurance Board of Appeal (EI BOA). These appeals used to be dealt with by the Social Security Tribunal – General Division (SST – General Division). The SST – General Division will still hear EI appeals underway before April 1, 2026.

If you disagree with the first-level appeal decisions made by the EI BOA or the SST – General Division, you can file a second-level appeal to the Social Security Tribunal – Appeal Division.

And if you’re not happy with decisions about your EI insurable hours or earnings, you can ask the Canada Revenue Agency to make a ruling.
