New Guided Pathway for motions in Small Claims Court
CLEO has a new, free Guided Pathway to help people who are involved in a case at Small Claims Court and want to ask the court to make an order.
The Guided Pathway helps you make a motion by filling out a Notice of Motion and Supporting Affidavit (Form 15A). It asks you questions about your situation and provides information to help you answer them. Based on your answers, it creates your forms and gives you instructions about how to file them with the court.
The Guided Pathway can help with any type of motion. It also provides extra guidance for some common motions, including how to:
- set aside a default judgment
- set aside a noting in default
- assess damages after a default judgment
- stop a garnishment
- remove a writ
- ask for permission to serve court documents another way
CLEO’s Guided Pathways are developed in partnership with Ontario’s Ministry of the Attorney General. They’re free online tools that help people understand legal processes and complete legal forms and documents.
