What if I have an employment contract?

Sometimes employers try to limit the amount of notice you can get by putting an amount in your employment contract.

If the amount of notice in the contract could be less than the minimum notice in the ESA, a court will not apply the contract.

There are other reasons why a court might order your employer to give you more than the minimum notice, for example:

  • the contract is not clear
  • your employer forced you to sign the contract
  • your employer tricked you into signing the contract
  • the notice under the contract is extremely unfair
